In fact, I know that the tablet recognizes my pen about 2 or 3 mm above the screen. When the pen touches the screen, it writes absolutely fine. It sounds like you have an issue with your digitizer. I would suggest you bring it back to get a new one. I just bought one and while it's a cool device otherwise the drawing aspect leaves a lot to be desired, I have to press pretty hard to get a line and it seems to drop in and out. I did install an updated driver and there is pressure sensitivity but having to almost dig into it doesn't seem right to me. I even borrowed another stylus, so I don't think that's the problem. Asus does make really good devices and the EP-121 is definitely a good example of that at the moment. The one thing that I would have liked is the fingerprint scanner as it would have made logging in a lot easier. Other than that, I have to say that it isn't lacking for much. The battery life for me is livable as I am able to plug in at most of the meetings that I'm in.
